The importance of arbitration has significantly grown since the mid-20th century until its end. It was in favor of the prosperity of international trade that the system of commercial arbitration emerged in the international community. Arbitration has become complementary to the role of the judiciary in resolving disputes of a private nature. It has also become an acceptable alternative to resorting to the courts, given its ease of procedure and speed, which align with the nature of international business transactions. Additionally, arbitration provides flexibility in determining the applicable law in case the disputing parties do not agree on it.
Given the global developments, including the continuous economic growth, increasing foreign investments, and the rise in international trade transactions, international and digital arbitration has become the preferred method for resolving disputes arising from these natural international and domestic trade disputes.
Hence, there was a need to establish a global organization for international and digital arbitration, encompassing all legal, judicial, and arbitration expertise in all its forms. This organization aims to be a new source of support for the arbitration process worldwide, especially institutional arbitration. It operates in accordance with rules agreed upon by the parties, whether those rules are stipulated in the laws, regulations, and arbitration systems of the world, the United Nations Commission on International Trade Law (UNCITRAL) rules, or any other rules agreed upon by the disputing parties, moving away from traditional arbitration.
From the outset, the organization adopted an international approach, aligned with its founders’ vision, which focuses on cultural exchange and global exposure. This is achieved through collaboration with international arbitration centers and institutions. It works in tandem with these centers and institutions to promote the culture of arbitration by organizing seminars, workshops, local and international conferences, and conducting a series of introductory, in-depth, and specialized training programs. The objective is to solidify the concepts of resolving commercial disputes through arbitration and encourage legal scholarly research in the field of arbitration. The organization also aims to disseminate research papers, journals, and publications that serve both the legal and business communities. It seeks to leverage the lists of arbitrators maintained by international arbitration centers and chambers, comprising leading arbitration experts from the Arab world and around the globe.
The establishment of the organization is characterized by its scientific openness, which is evident in the magnitude of its scientific achievements and cultural activities across all scientific fields. The creation of the organization sends a message to the global community about a bright future for a global arbitration community that boasts legal arbitration expertise, under the banner of the International and Digital Arbitration Organization.
